Terms and Conditions - Britain's Brainiest Family

  1. The competition is open to GB residents, excluding the employees and the families of the Promoter, its agents or anyone professionally connected with this promotion.
  2. To qualify as a family team for this competition you must fit the following definition: All members of your team must be GB residents. You must either be a legal guardian, blood relation or be co-habiting with at least one member of your team. Extended family is included. Your team may have no more than 5 members and no less than 3. You may have no less than one adult and no more than 2 adults in your team. Adults are classed as any person aged 17 and over, children are classed as any person aged 16 and under and must be a minimum age of 6 on the day of the competition.
  3. To apply to take part in the promotion 1 family member must register at the designated registration area on any of the event days. All participants on the day must sign the relevant documentation to ensure they meet the required criteria. Failing to do so removes the rights of the entire team to enter the competition. A person may enter for only one team and a team may make only one entry. All team participants acknowledge that competition entry entitles the promoter to use their photo and film footage for promotional, publicity and online purposes.   4. By entering the competition you agree to the use of photography and filming for broadcast television, media and publicity purposes.
  5. There are a total of 10 regional heats.
  6. Each regional heat winner will receive a Wii and Big Brain Academy Game and a Thomas Cook holiday. Regional winners will only be eligible for the Thomas Cook holiday if they attend the final on 4/11/07.
  7. The holiday prize will be a Thomas Cook package holiday for 7 nights accommodation for up to 2 adults and up to 3 children (up to age 16). The holiday will include self-catering accommodation, flights and local transfers. The prize is valid for travel May - October 2008, excluding 24-31 May, 18 July - 29 August & 25-31 October departures. Flights are from Gatwick or Manchester. Prize holidays must be booked by the 31st December 2007. The lead name on the booking for the prize holiday must be over 18 years of age. It is the prize winner's responsibility to ensure they have the correct visa, travel insurance and health documents. No cash alternative to the prize is available. No meals, or personal and incidental costs will be included in the prize.
  8. Thomas Cook will choose the holiday prizes from selected Thomas Cook brochures. Holiday prizes will be drawn at random and allocated to winners. Winners must accept their allocated holiday and cannot amend, delete, transfer or upgrade it. Travel dates are subject to availability at time of booking. Tour operator's booking conditions apply in addition to these competition terms and conditions.
  9. The regional heats run during the opening hours at the following shopping centre locations: Glasgow, Braehead Centre; Gateshead, MetroCentre; Sheffield, Meadowhall; Manchester, Trafford Centre; Birmingham, Bullring; London, Brent Cross; Milton Keynes, Midsummer Place; Southampton; WestQuay; Bristol, The Mall Galleries; Kent, Bluewater. The promoter reserves the right to change locations without notice.
  10. In the case of a competitor invalidating the regional heat, the promoter reserves the right to remove them from the competition. Invalidation includes the abuse of staff and or participating applicants; intoxication; and inappropriate attire such as nudity or violent messaging.
  11. No responsibility will be accepted for any registration that is illegible, incomplete or does not comply with these terms and conditions in any way.
  12. All associated costs for travel, parking and other contingencies are the responsibility of the participant for the regional competition.
  13. The winners of the regional heat will be determined based on their performance. All applicants will have their results recorded and the winner will be determined at the end of each location. All regional winners will be required to prove their claimed relationship with the relevant documentation. In the case of a tie for the regional heats, a random selection will take place by an independent party. All regional finalists will be publicised on www.britainsbrainiestfamily.com
  14. Heat winners will be notified by telephone or email by 29/10/07. Winners must confirm their attendance at the final by replying to the notification e-mail with confirmation of receipt and postal address, at which time they will be sent a Nintendo Wii console and Big Brain Academy game. In the event of a regional winner not replying by 31/10/07 to the notification of winning, an alternative prize winner will be drawn and the previous winner shall forfeit any further prizes.

The Finals

  1. From the 10 regional heats, 10 final families will be produced, plus an additional 1 finalist from the Virgin Radio Competition. The final will be held on Sunday the 04/11/07 and will require participation from 9am till 5pm. In the event that any members of the regional winning team are unable to attend this date, the team forgoes the right to participate and up to 48 hours before the final, the next highest result family from that region will be invited to participate in the final.
  2. In the event that a family drops out within 48 hours of the final. The number of finalists will be reduced accordingly.
  3. Reasonable associated expenses incurred from participation in the final will be covered by the promoter, to include family accommodation and travel. Food and beverages will be provided on the day.
  4. In the case of winners missing or invalidating the final competition, the promoter reserves the right to remove their placing from the final.
  5. Invalidation of the final competition includes the abuse of staff and or participating applicants; intoxication; and inappropriate attire such as nudity or violent messaging.
  6. All participants in the final are playing for the chance to win 'Win university fees for their kids'. This prize is for up to the value of £10,000 per child for a maximum of 4 children. The total value of the potential prize is £40,000 which will go towards the costs necessary to participate in higher education. The prize is non transferable and includes contributions to fees, textbooks, travel, accommodation, costs necessary to participate in higher education at a university or educational institute and any other expense that can be proven to be associated with the education of the winning young adult.
  7. A child who benefits from the prize must have participated in the competition.
  8. Once a winning family has been determined, we will appoint a professionally regulated firm to decide the most appropriate means of managing the winners' funds. This might include investment of the money in a trust fund or trustee bank account which will have impartial trustees. The promoters decision is final.
  9. The winner forgoes the right to mention the name of the promoter and all participating professionals in Public Relations, unless permitted by the promoter directly.
  10. The winning entrant of the grand prize must be able to attend a PR event on Monday the 05/11/07 to meet with journalists and have their photos taken. The promoter reserves the right to use these photos for publicity.
  11. In the case of death, the fund / prize pool will be returned to the original owner / promoter.
  12. In the case of a tie, the families will be asked to replay until a clear winner is determined.
